CONCLUSION AND TERMINATION OF THE SALE AGREEMENT

These Terms and Conditions as well as individual terms of sale indicated with information about certain products represent the offer of Fashion ordination d.o.o. for concluding the Contract, and the user as the Buyer by his registration, concluding the order or otherwise determined by these Terms accepts it, which is considered a contract between the user and the company Fashion ordination d.o.o., and according to the terms of sale specified in these Terms.
By registering in the EtnaMaar Online Shop and / or subscribing to the Newsletter, the user agrees that Online Shop EtnaMaar may notify him by e-mail about changes or additions to the site, discounts, promotions, products or changes in the way of providing the service. The user can change his mind at any time and unsubscribe from the list of recipients of the Newsletter.The purpose of the Agreement is to purchase the selected product through the EtnaMaar Online Shop by paying the appropriate fee (price) for that product and the associated price of the delivery service of the same product. The contract is concluded by means of remote communication (Contract concluded at a distance) via: internet orders in the EtnaMaar Online Shop, printed promotional messages with the purchase order and telephones with human mediation. The User is authorized to choose the possibility for the Seller to inform him about new products, products on sale, etc. (newsletter). After the successful registration (correctly filled in all required data), a notification of successful registration will be sent to the user’s e-mail. All product prices on the website www.etnamaar.com are expressed with VAT included. Before concluding the Agreement, the user has the opportunity to review the Terms by clicking on the Terms of Purchase. The contract enters into force and is binding from the moment the user accepts the offer of Fashion ordination d.o.o. in one of the following ways:
– by selecting the payment and completing the order as a registered user of the EtnaMaar Online Shop,
– by selecting the payment and completing the order as a guest user of the EtnaMaar Online Shop,

In the process of registering or creating a user account, the user is obliged to choose the name or name under which he will provide services and choose a security password and provide a valid e-mail address. All information required to register or create an account must be true, and the use or use of other people’s data is expressly prohibited.The registration or user account is created for one person only and it is not allowed to disclose the registration or account information to third parties. The user is obliged to keep information about his security password and user account. The use of someone else’s registration or account is not allowed.

For violation of the provisions of the Terms of this chapter, Fashion ordination d.o.o. reserves the right, at its sole discretion, to terminate the registration or user account of the user, without obligation to compensate the user for any cost or damage.

The Agreement shall enter into force when the User accepts the offer to enter into such Agreement. Product sales agreement between the Buyer and Fashion ordination d.o.o. it is concluded at the time of payment for the product.

On the occasion of concluding the Agreement, the user will be electronically enabled to view and / or send an e-mail to the e-mail address containing: confirmation of the concluded Agreement, ie pre-contractual notice from Article 57, paragraph 1 of the Consumer Protection Act (OG 41/14) , this Condition, and the notification on the right of the user to unilaterally terminate the Agreement with the form for unilateral termination of the Agreement referred to in Article 61, paragraphs 1 and 2 of the Consumer Protection Act.

The User / Buyer may unilaterally terminate the Agreement within 14 (fourteen) days without giving a reason. According to Art. 79, paragraph 1 of the Consumer Protection Act (OG, 41/14), the user is not entitled to unilateral termination of the Agreement if the service is fully fulfilled, and the fulfillment began with his explicit prior consent and with his confirmation that he is aware of the fact that will lose the right to unilaterally terminate the Agreement if his service is fully fulfilled.
In order for the Buyer to be able to exercise the right to unilaterally terminate the Contract, he must notify Fashion ordination d.o.o. on its decision on unilateral termination of the Contract before the expiration of the term by an unambiguous statement sent by mail (to Fashion ordination doo, Ilica 82, 10000 Zagreb) or by e-mail to: info@etnamaar.com, stating your name and surname, address, telephone number or e-mail address, order or invoice number, and may use the above written form for unilateral termination of the Agreement. If the user unilaterally terminates the Agreement, he will be refunded the money received from him, including delivery costs, without delay, and no later than 14 (fourteen) days from the day when Fashion ordination doo or Online Shop EtnaMaar receives the user’s decision on the unilateral termination of the Agreement. The refund will be made in the same way as the user made the payment. In the event that the user agrees in another way to refund the amount paid, he does not bear any costs in relation to the refund. According to the Consumer Protection Act (OG 41/14, Art. 77), the costs of returning goods must be borne independently. The buyer is responsible for any impairment of the goods resulting from the handling of the goods.

If, at the request of the Buyer, the performance of the service started during the deadline for unilateral termination of the Contract, the Buyer is obliged to pay the company Fashion ordination d.o.o. an amount commensurate with what has been delivered up to the time the Buyer has notified Fashion ordination d.o.o. on the unilateral termination of the Agreement. FORM FOR UNILATERAL TERMINATION OF THE CONTRACT ON PURCHASE OF PRODUCTS AND SERVICES

The basic characteristics of the product (raw material composition, available sizes, and colors), prices, special promotions and benefits, methods of payment and delivery refer to those that are valid at the time of the concluded order. The information provided will be indicated with each product. The price of the product, which includes the amount of VAT and shipping costs, are visible in the shopping cart before concluding the order. The cost of delivery can also be seen on some other parts of the site. All information on the purchase confirmation based on the electronic order will be delivered to the customer’s e-mail address specified in the registration / order procedure or in the shopping cart when entering data when concluding the order. All prices are expressed in Croatian Kuna (HRK). All prices of products and services offered on the website www.etnamaar.com include VAT.Fashion ordination d.o.o. treats selected products in the basket of a registered or unregistered user as an order, and reserves the right to cancel it for a justified reason. If the Buyer does not receive the order confirmation notification, there is a possibility that he has entered his e-mail address incorrectly. At the time of ordering an individual product from the offer, the user / buyer (in terms of the Consumer Protection Act) by agreeing to the Terms of Purchase confirms that before concluding the contract he received information published on www.etnamaar.com and its subpages, ie: name, company or the name, registration number and registered office of the Merchant in the ways in which he may raise his objections; information and products offered, and their name, main characteristics as well as the price of the product, including all taxes and other charges; product delivery cost information; as well as information on the method of payment, and the method and deadline for delivery of products.

Online Shop EtnaMaar (Fashion ordination d.o.o.) is obliged to submit to the user / Customer (in terms of the provisions of the Consumer Protection Act) a confirmation of the above content in written or other available durable medium, as soon as possible and at the latest at the time of delivery. By agreeing to these Terms, the User / Buyer agrees that the confirmation of the previous notice is sent to him by e-mail to the e-mail address specified as a contact when entering his order.METHOD OF PAYMENT

Payment of the product price and delivery costs can be made in one of the following ways:

a) Cash on delivery – the goods are paid for upon delivery by the express courier service. Payment is made exclusively in cash.

b) Payment by credit and debit cards – we only accept Maestro cards, MasterCard cards, Visa, Visa Electron, Vpay cards, Diners Discover cards

c) Payment by general payment slip – products for which an order has been concluded can be paid by payment via a general payment slip in all branches of banks, FINA or Croatian Post offices. After confirming the order, the Online Shop EtnaMaar forwards by e-mail the information required for payment by general payment slip. All data must be entered correctly in the general payment slip and payment must be made within 7 days.

d) Payment by internet banking – products for which an order has been concluded can be paid via internet banking of any bank in which the possibility of such a method of payment is open. After confirming the order, the Online Shop EtnaMaar forwards by email all the necessary information to make the payment.

When choosing to pay with a general payment slip, the Buyer receives all the information needed to make the payment at the email address (specified in the order).

The Customer’s cash receipt includes the payment received to the giro account of Fashion ordination d.o.o. or Customer credit card authorization approval. Payments made by the Customer on Friday are most often visible on Monday, when the products are sent by express delivery service.

PRICE AND DELIVERY CONDITIONS
The cost of delivery is calculated automatically when purchasing the product, and the electronic system of the Online Shop EtnaMaar then issues a purchase order with the price of the purchased products and the delivery price. The cost of delivery is the amount separately stated in the basket below the price of one or more ordered products and represents a fixed amount of HRK 25.00 (including VAT). The delivery price is the same for the entire region of the Republic of Croatia, regardless of weight, volume or customer address. For the amount of the order above HRK 500.00, delivery is FREE. The deadline for delivery of products, which are stated to be in stock, in the whole of Croatia is 5-7 working days from the date of receipt of payment by the user / buyer to the bank account of Fashion ordination doo, except in cases where the ordered products are currently not in the nearest warehouse. They are then withdrawn from other sales units owned by Fashion ordination d.o.o. in the territory of the Republic of Croatia. In the case of such a withdrawal of the product, it is possible that the delivery of the product will be delayed for the period initially required to obtain the ordered product in the warehouse from which the products are issued for sale through the EtnaMaar Web Shop. The same procedure and extended delivery time applies to discounted items.

If the company Fashion ordination d.o.o. is not able to deliver any of the ordered products, the sales staff will contact the Buyer by phone or email to arrange a replacement of the product or cancellation of the ordered product. All other ordered products will be delivered.

The cost of delivery is charged when calculating all the costs of the order and according to the tariff of the delivery service. All products are delivered by express delivery service DPD d.o.o. within 5-7 working days from the receipt of the Customer’s payment to the account of the company Fashion ordination d.o.o.
REPLACEMENTS, COMPLAINTS AND COMPLAINTS, AND MATERIAL LIABILITY

In the case of a justified complaint, it is possible to terminate the contract with a refund or replacement of the product. In the event of damage and / or defect of the delivered goods, the Buyer may return the item to the above address, so that the complaint is accepted on the basis of physical evidence. If a careful inspection reveals that the product has been damaged by intentional / accidental mechanical action, ie tearing of materials, buttons, thread, zippers, brooches, rivets, beads or other components of the product, which occurred after the product was inspected and sent to the customer , the complaint will be rejected or disputed. In such a case, the material responsibility of the buyer for the purchased product is determined.
It is also emphasized that according to Art. 43 of the Consumer Protection Act (OG 41/14), paragraphs 5 and 6, there is a right that, if a material defect in the product occurs within six months from the date of transfer of risk to the Customer (from the date of purchase of the product), and the trader considers that the defect did not exist at that time, the costs of the expertise are borne by the trader. If a material defect in the product occurs after six months, but not later than 24 months from the date of transfer of risk to the Buyer / consumer, the costs of the expertise shall be borne by the consumer or trader, depending on the result of the expertise. The dealer is not liable for material defects in the product that occur after two years from the purchase of the product.

The product to be advertised must contain the original sewing label of the EtnaMaar brand, and if possible be presented with the original invoice.
